Are You Married Or Not?

Are You Married Or Not?

That should be an easy enough question.  At least I would think so.  I had a wedding ceremony and signed the papers and everything.  I am married. I think.  The minister was "The Minister of the Golden Keys."  My mother-in-law chose him.

The younger generation doesn't always know what that line is. More and more of that generation aren't getting married but are still living together.  That is when the line can get a little blurred. Remembering,I only ask so I know who to put on the contract and who needs to be on the mortgage.

Here are some of the responses I get when I ask the question "are you married"?


  • I don't know
  • No, but we have been together ??? years
  • Yes, but I am separated
  • In the U.S.?
  • I'm not sure--I haven't seen him/her for 20 years
  • Not legally
Have you gotten similar responses?  Texas is a Community Property state and most of those answers can cause distress at the least and sometimes panic.  And quite often argument.

If you are paying cash for the property, it doesn't matter--when you buy.  It will matter, though, when you sell.  (I am not an attorney).

The rule, of course, is that if you are married your spouse, simply put, has to be obligated on the mortgage with you. 

Let's examine the answers.

I Don't Know

What can that possibly mean?  Amnesia?  A midnight trip to Vegas?  

No, But We Have Been Together ??? Years

There are a couple of responses to that.  First, Texas recognizes common law marriage.  If you have filed taxes together you are considered married.  For better or worse.  If you haven't filed taxes then I guess you aren't really married.  ?? Interestingly if you have filed Texas together even though you haven't had a marriage license, if you split up you have to get a divorce. Tricky, huh?

Yes, But I Am Separated

Sorry honey.  Your separated spouse will still need to sign.

In The US?

Yes.  If you are buying property here you need to follow US guidelines.  Since I live in Texas it is common for some of my clients to be from Mexico.  US recognizes Mexican marriages so spouse will need to sign.  That can become a complication if spouse is still in Mexico but it can certainly be done.

I am not sure--I haven't seen him/her for 20 years

Did you get a divorce?  Then you are still married.

Not legally

Are you illegally married?

This question is really a black and white question.  Either you are or you are not.

Amarillo Sellers: Please Turn On Your Air Conditioning!

It is hot here in Amarillo.  

During this time of year in Amarillo it is very important that if you want to sell your house fast, you will turn down the air.  I know it may cost you a couple of hundred dollars extra by keeping it low but if it takes you 2-3 extra months to sell your house you have spent more than $200.

Picture this.  It is 102 and I am showing potential buyers houses. We have narrowed their search down to 3 houses that fit their needs.   

We go to house #1.  It meets all of their needs as we knew it would but by the time we have walked through the house once, we were so hot we left just to get into the air conditioned car. The thermostat was on 79.  They liked the house.


House #2 equally matched their needs.  They were really interested in the back yard in this house. We walked through the house first and then went to the backyard.  There was no shade so we didn't stay long.  Trying to escape the heat we went inside but it felt as warm in there as it did outside.  We walked right back out the front door and into the air conditioned car.  I didn't notice what the thermostat was on.  They liked the house.

House #3 equally matched their needs.  When we walked into the house we were met with cool air. It was such a relief that we walked slowly from room to room pointing things out and talking about colors and flooring.  We hung around in the kitchen checking drawers and measuring the pantry shelves.  The back yard was great and when we escaped back inside we were cooled down immediately  It felt so good we sat down in the living room and discussed particulars on the house. We talked about what they might change.  We talked about financing and payments.  We spent 40 minutes at the house.  They liked the house.


Which one would you choose?  Equal houses.  Two hot and one cool.  

That may seem like a silly reason to not buy a house but the truth of the matter is that if it is uncomfortable in the house, buyers won't linger and therefore don't get a picture of the little things. They really just took a cursory look.  They aren't as apt to buy the hot house because they really didn't see it all.  They were too anxious to leave.

So are you ready to sell your house in hot Amarillo?  Remember to keep your house a little cooler than cool.

First Class or Coach?

My husband and I recently flew to Maine for a vacation.  We live in Texas so the 2nd leg of the trip was more than 3 hours.  We had a full plane both ways. I got the middle seat both ways.

There were no crying babies or snoring passengers but crammed into a seat with a couple of arm-rest hogs for more than 3 hours at a stretch was taxing to say the least.  

When we got home I told my husband that the next time we flew we were going to fly first-class.  It might cost a little more but it was well worth it.

It got me to thinking about Realtors and how we do our business. 

Are we giving our clients First-Class service or are we treating them like they are in Coach class? An even more pin-pointed distinction is, are we treating our $100,000 the same as our $400,000 buyers?

I read a book a long time ago title "It Takes So Little To Be Above Average" by Florence Littauer. The title describes the book.  Going above and beyond just a little bit will put you above average. I want all of my clients to feel as though they have gotten First Class service by an above average Realtor.

Not everything about First Class service comes naturally.  

Sometimes it feels like a chore to call that seller with no news. But making that call will probably put you ahead of the norm. Sometimes it can be so hard to listen when you already know the answer.  Taking the time to listen intently will make a difference to that buyer or seller.  These are things that you must do on purpose.  

So when you go out there working with your sellers and buyers, remember that they deserve First-Class service!

6 Steps To Success

Recently I watched a video done by Arnold Schwarzenegger (spell-check couldn't get that one) as he talked about 6 Steps To Success.  I really liked the information so I thought I would share it with my own twist.


  • Who Do I Want To Be?

There is a BIG distinction between "who" and "what".  I hadn't really thought much about that but when it was pointed out it was an "aha" moment. This is something that we have to reach down really deep to figure out what the answer is.  And then it takes a lot of thinking.  

The more I thought about it the more I knew that the answer was "to be someone who selflessly helps other to be better".  As much as I work and strive to build my business, I realize it is more about helping and watching others grow and succeed than anything else.  I love it when a team member gets an"aha" or reaches a milestone.  

You may be reading this and thinking that you feel the same way. Great!  The world would be a much better place if we helped each other instead of tearing each other down.

  • Break The Rules
This one is easy for me.  I love to push the envelope.  The distinction is to break the rules NOT the law.  I draw the line there, too.  

One of the great reasons for breaking the rules is to find new ideas--to think outside the box or the normal thinking.  I don't need to re-invent the wheel but I might want to add some new tires. Besides, if you aren't breaking the rules how boring would life be! 

  • Don't Be Afraid To Fail
This is really hard for some people.  It has never really bothered me much. That is a good thing because I have failed a lot.  

I don't go into something, though, with 100% surety that I will fail. Like, for instance, jumping out of an airplane without a parachute and trying not to die.  I will go into something that I am certain won't kill me and I can see that the end result is worth failing a few times to get there.  

  • Don't Listen To Naysayers
Maybe a whole set of new positive, high-minded friends is in order.  I know in my journey I have had to leave a few people.  I want people in my life that encourage me and help me stay positive and focused.  

Negativism is like cancer.  It spreads and is hard to kill.  It is often fatal.  If you have that in your life I would suggest you get rid of it ASAP.

  • Work Your Butt Off
It is not about just working to work.  It is about working with a purpose and on purpose.  You can dig as many ditches as you want, and that is hard work, or you can dig your way out of a ditch and move forward.

One thing Arnold said that I thought was cute is paraphrased "With 6 hours of sleep at night that gives you 18 hours to work.  If you are sleeping 8 hours a night you need to learn to sleep faster". That made me chuckle.  I need to sleep faster.

He also talked about something that Mohammad Ali said.  No Pain--No Gain. When asked how many sit ups he did he responded by saying that he didn't know.  He doesn't start counting until it hurts.  That really hit home for me.  I am more apt to do sit ups (or any other project)  until they START hurting.  That was an "aha" for me. 

  • Give Back
So it comes full circle.  To be "who" you want to be you probably are going to have to Give Back to make that happen.  

Until I have enough money to make a difference in a giant way, I am satisfied with helping one person at a time to be better.  :-)
